Consumer Complaints

If you are having some difficulties with a mortgage broker in the state of Kansas, this information may help. Please try to contact the following people, in the order listed, to resolve your situation:

1. First, state your concerns to your loan officer in writing.

2. If that does not satisfy you, contact the Branch Manager or state-listed contact person of the mortgage broker involved. You may want to put your concerns in writing even if you meet in person with this individual. If you have problems getting the proper name of the state-listed contact person or Branch Manager, you can get the name from our KAMP web site link "Regulatory Contacts, See if Your Broker is Licensed". You can also call the Kansas Office of the State Bank Commissioner at 785-296-2266 or visit them online at www.osbckansas.org.

3. You may file a formal written complaint with KAMP, PMB 234, 14904 W 87th Parkway, Lenexa, KS 66215-4159. We require a letter describing the situation in detail, a timeline of what happened, supporting documentation (should include Good Faith Estimates, Loan Applications, Loan Papers, etc.) and what type of resolution you are seeking. Your letter will be given to our Past President’s Council for review. While we cannot guarantee to correct your personal situation, our goal is to facilitate a resolution between you and your member broker.

4. You may also file a formal written complaint with the State of Kansas, Office of the State Bank Commissioner, Division of Consumer and Mortgage Lending, 700 Jackson, Suite 300, Topeka, Kansas 66603, (785) 296-2266. They require a complaint be submitted in writing and include the name of the institution, the city in which the institution is located, and a brief description of the question or problem. Once the complaint is received by the OSBC, it will be mailed to the President of the institution with a request they review the circumstances surrounding the complaint and provide a written response which constitutes the institution’s position on the issue. Upon receiving the institution’s written response, the OSBC will review the facts and determine the appropriate course of action. The OSBC accepts phone calls, but needs a written complaint to open a complaint file. The OSBC normally cannot correct your personal situation, but can sanction a company for violations of the law, which may help prevent future consumers from being harmed.

5. You may also contact an attorney and pursue a private course of action. To get a referral to an attorney if you do not already have one, contact the Kansas State Bar at 785-236-5696 or visit them online at www.ksbar.org.
